AUSTIN, Texas – The Texas Public Policy Foundation applauds the Texas Legislature and Governor Abbott for the passage of Senate Bill 8, landmark legislation that mandates participation in federal immigration enforcement programs for sheriff’s departments in counties that operate a jail or contract with a private vendor to operate a jail.
“Senate Bill 8 represents a decisive victory for the rule of law and Texas communities,” said Greg Sindelar, CEO of the Texas Public Policy Foundation. “This legislation ensures that most counties in Texas will work hand-in-hand with federal authorities to secure our borders and protect our families from the ongoing public safety crisis.”
The legislation comes following President Trump’s January 20 Executive Order “Protecting the American People Against Invasion” and the Department of Homeland Security’s formal declaration of a “Mass Influx of Aliens.” These federal actions authorize Texas law enforcement officers to perform the full range of ICE duties, including arrest powers, detention authority, and preparation of charging documents.
“Texas has endured devastating effects of unchecked illegal immigration, cartel-driven human trafficking, and smuggling networks that overwhelm local law enforcement,” said Selene Rodriguez, campaign director at the Texas Public Policy Foundation who testified in favor of the bill. “SB 8 provides the legal framework for a coordinated, statewide response. We are grateful to Senator Schwertner and Representative Spiller for their leadership on this bill.”
The 287(g) program allows trained local officers to identify, process, and detain immigration violators during regular law enforcement activities. By requiring participation from all major county sheriff’s departments, SB 8 eliminates gaps that criminal organizations have previously exploited.
“This is Texas’ moment to set a national standard in immigration enforcement,” Rodriguez concluded. “Nothing is more fundamental than states’ ability to defend their borders and protect their sovereignty.”
